HALLOWEEN ACTIVITIES WAIVER RELEASE, WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT READ BEFORE SIGNING 

A Fully Executed Agreement Is Required For Participation in Halloween Activities, Halloween Carnival, Halloween Poolside Movie Night. In consideration of being allowed to participate in activities sponsored by Wyndham Palms Master Community Association, Inc. (“Association”), including, but not limited to, HALLOWEEN ACTIVITIES/CARNIVAL/POOLSIDE MOVIE NIGHT to occur on OCTOBER 26.2024 (“HALLOWEEN ACTIVITIES”) at or around the premises known as Windsor Palms Resort Clubhouse, which is located in the Windsor Palms Resort (“Windsor Palms”) at 2300 Wyndham Palms Way, Kissimmee, Fl 34747, the undersigned acknowledges, understands and agrees that: 

1) The moderators, volunteers, and agents of HALLOWEEN ACTIVITIES are not employees of the Association or any other Windsor Palms related Association (“Associations”). 

2) An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and Guests with underlying medical conditions are especially vulnerable. By participating in HALLOWEEN ACTIVITIES, you voluntarily assume all risks related to exposure to COVID-19 and agree to take necessary precautions to protect yourself and others; and, 

3) I willingly agree to comply with all Federal, State of Florida and local County laws, executive orders, rules, ordinances, and recommendations, and also all covenants, bylaws, rules and regulations of the Association. If I observe any unusual significant risks or hazards during HALLOWEEN ACTIVITIES, I will remove myself from said locations and participation and bring such risks and hazards to the attention of a volunteer or moderator of HALLOWEEN ACTIVITIES immediately; and 

4) In consideration for my participation in HALLOWEEN ACTIVITIES, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, ACQUIT, WAIVE, DISCHARGE, COVENANT NOT TO SUE, AND HOLD HARMLESS the Association and its officers, directors, managers, agents, employees, volunteers, members, tenants, guests, and attorneys, (“Released Parties”), with respect to any and all illness, detrimental health issues, injury, disability, death, liability, claims, demands, economic losses, causes of action whether at law or equity, orloss or damage to person or property, that may be sustained by me, WHETHER CAUSED BY OR ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW, DUE TO PARTICIPATING IN HALLOWEEN ACTIVITIES. I also understand that the Released Parties will not be responsible for any medical costs or other economic losses associated with any illness and/or injury I may sustain while participating in the HALLOWEEN ACTIVITIES. 

5) It is my express intent that this Release, Waiver of Liability, and Hold Harmless Agreement shall bind me and the members of my family and spouse (if any), if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a total release and waiver as to the Released Parties. This Release, Waiver of Liability, and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Florida with venue exclusively vested in Osceola County, Florida. In signing this Agreement and release, I acknowledge and represent that I have read and understand it and sign it voluntarily; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement and release for full, adequate and complete considerations fully intending to be bound by same. 

6) The undersigned expressly agrees that the foregoing Release, Waiver of Liability, and Hold Harmless Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Florida and that if any portion or portions thereof shall be held invalid, it is agreed that the balance shall continue in full legal force and effect. 

IMPORTANT: THIS DOCUMENT IS A RELEASE OF LIABILITY AND AFFECTS YOUR LEGAL RIGHTS. YOU MAY WISH TO CONSULT AN ATTORNEY PRIOR TO SIGNING IT. DO NOT SIGN THIS RELEASE IF YOU DO NOT UNDERSTAND OR DO NOT AGREE WITH ITS TERMS. IN SIGNING THIS AGREEMENT AND RELEASE I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE, WAIVER OF LIABILITY, AND HOLD HARMLESS AGREEMENT AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
